Terms and Conditions

Should the governess leave within the first ninety days of commencement of employment, we will undertake to replace her, free of charge, with another suitable candidate. The request for such a replacement must be made, to the agency, within 30 days of the previous candidate having left the position and we will "pull out all stops" to find a replacement. It stands to reason that we are unable to put any time frame on such a replacement as we would need to source a suitable candidate.
Should the governess leave after ninety days, but prior to a year (only in the event of the candidate being a Permanent placement), we would find a replacement, bill the client in full for the replacement, then pass a credit for the number of months for which the initial governess did not work, up to twelve months. (For example, should the initial governess leave after eight months, after being employed on a permanent basis, we would invoice the client in full for the replacement, at our normal rates, then, on the same invoice credit the client for four twelfths of the amount of the initial invoice).
It should be clearly noted that the above guarantees are not extended with the start of employment of subsequent candidates after the original placement.
EMPLOYMENT INDEMNITY
Governess Connection takes every care and attention in selecting suitable applicants. Due to the nature of services undertaken, Governess Connection takes no responsibility for the conduct or actions of applicants once placed and whilst they are in the employ of the client. Governess Connection provides, as a service, an Employer / Employee contract but takes no responsibility for any dispute arising between the Employer and Employee.
1. PLACEMENT FEE STRUCTURE
- (a) We require the signature of the person responsible for payment of placement fees on this contract and payment of a once-off registration fee of R300.00 (inclusive of VAT), before commencement of recruitment.
- (b) The placement fee for successfully placing a candidate in a Permanent position is 12% of the annual package (plus VAT). For Semi-permanent placements, (seven days or more, but not permanent) the placement fee would be 30% of the agreed upon package, plus VAT.
- (c) The package on a Permanent placement will include the monthly salary paid to the candidate, plus any other allowances agreed upon, e.g.; travel, petrol, babysitting, etc. Should the candidate live with the employer (albeit in separate accommodation), a Live-In Fee of R1, 000-00 per month will be added to the value of the package (for the purpose of invoicing only).
- (d) The fee in respect of a Temporary placement is payable in full to the agency prior to the commencement of the assignment. Placed Temporary candidates will be in the employ of the agency, i.e. candidates will be paid directly by Governess Connection at the conclusion of the assignment, excepting mileage, spending monies, etc. which will be paid directly to the governess at the end of her assignment by the client. A minimum invoice amount of R250-00, excluding the registration fee and VAT, will be applicable for all Temporary assignments.
- (e) All relevant fees will be payable to Governess Connection (inclusive of VAT).
2. GUARANTEES
- a) Governess Connection provides a two-tier guarantee for Permanent placements, i.e. a NINETY DAY free replacement guarantee, and a ONE YEAR credit guarantee. For Semi-Permanent placements, the guarantee would include a free replacement applicable for the first ninety days, where possible, or a pro-rated refund. Temporary placements will either be replaced or refunded on a pro-rata basis, depending on the circumstances.
- b) The terms of the free replacement guarantee are that Governess Connection will provide a suitable replacement, acceptable to the customer, free of charge should the applicant resign or be dismissed for any reason (within the first ninety days of employment for Permanent placements). This will be attended to as a matter of urgency, but no time frame can be placed on finding another suitable candidate. Requests for the replacement must be made to the agency within thirty days of the previous employee having left the position, for Permanent placements and within forty eight hours for Temporary or Semi-Permanent placements.
- c) Should the Permanent employment be terminated after the initial ninety day period, but before the completion of twelve months, a credit is passed to the client's account for the period that the candidate did not work, to be offset against a future placement by Governess Connection on condition that the future placement is requested by the employer within thirty days of the termination of the previous employee having left her employment.
- d) The guarantee period is not extended with the start of employment of subsequent applicant(s) after the original placement.
NB.: The above guarantees will only apply subject to the invoice payment terms having been met.
3. PAYMENT TERMS
Invoices are payable in full on or before the first day of commencement of employment, unless otherwise agreed.
- 4. Should a replacement be offered a higher salary than the previous applicant, the Client will be required to remit the difference of the placement fee, on the higher salary, on the same terms as those described above. This also applies should an applicant, after resignation, accept a higher package from the same employer and return to her position.
- 5. No refund will be made to the employer should a replacement accept the position at a lower salary than that of the original candidate.
- 6. Should any applicants referred by Governess Connection. be employed by a Client on any terms whatsoever which excludes the agency's involvement, within twelve (12) months of the original introduction by the agency, the Client will then be liable for a fee in accordance with the Terms and Conditions as set out above.
- 7. A cancellation fee of R1500-00 will be payable should the Permanent appointment be cancelled by the client within 7 days prior to commencement of the assignment. In the event of a Temporary or Semi-permanent assignment being cancelled by the client within 72 hours prior to commencement, a cancellation fee of R1000 will be payable, according to our Terms and Conditions. These fees exclude VAT. Cancellation fees are payable within three working days of the cancelled start date.
- 8. Once a candidate has been appointed, we request that we are advised of the appointment in writing prior to the commencement of the assignment. Our preference is our "Confirmation of Appointment" form being completed (available from our offices) and signed, or a faxed letter from the Employer giving details of the appointment.
- 9. In the event of non-payment of placement fees by the due date, the Client will be responsible for all collection and / or legal fees and other costs incurred by the Agency, in the process of obtaining the placement fee. Interest on overdue amounts will be charged, effective from the due date as stipulated on the invoice, at a rate of prime plus three percent.
- 10. These Terms and Conditions will be considered to be accepted prior to the Employer agreeing to receive CV's, interview and / or appoint any applicant referred by Governess Connection and will remain valid for all future placements, unless a new contract has been presented to and signed by the client.
THE ABOVE TERMS AND CONDITIONS SHALL BE CONSIDERED TO BE APPLICABLE AND BINDING UNLESS VARIED BY MUTUAL AGREEMENT AND IN WRITING.
